Repealing ObamaCare Would Be ‘Unconstitutional’ According To Rep. Sheila Jackson Lee

According to Jackson Lee, passing the GOP’s repeal bill — H.R. 2 — would violate the Fourteenth Amendment’s equal protection clause because it would leave some Americans uninsured:
Later, on the floor of the House of Representatives, Jackson Lee expanded her case, claiming a repeal of the health care law would also violate the Constitution’s Fifth Amendment guarantees of due process.
“The Fifth Amendment speaks specifically to denying someone their life and liberty without due process,” the Texas Democrat said. “That is what H.R. 2 does and I rise in opposition to it. And I rise in opposition because it is important that we preserve lives and we recognize that 40 million-plus are uninsured,” she said.
“Can you tell me what’s more unconstitutional than taking away from the people of America their Fifth Amendment rights, their Fourteenth Amendment rights, and the right to equal protection under the law?”
“This bill has been vetted. This bill is constitutional and it protects the Constitutional rights of those who ask the question: ‘Must I die? Must my child die, because I am now disallowed from getting insurance?’” (h/t AmSpectator)                                                                                                                                                All of the sudden the Democrats care about the US Constitution. Too bad they don't understand it. I wonder if the left will start using the 14th Amendment to socialize other things like housing and food? If that is the way they understand the 14th Amendment then why wouldn't they? Maybe someone should ask her if making the unions and some businesses exempt from obamacare taxes is Constitutional under the 14th Amendment? Or if having a mandate that makes Americans buy a product is Constitutional? Here is the 14th Amendment, lets take a look and see if Rep.Jackson Lee is diluted in her interpretation of this amendment:

Amendment 14 - Citizenship Rights


1. All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
2. Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed. But when the right to vote at any election for the choice of electors for President and Vice-President of the United States, Representatives in Congress, the Executive and Judicial officers of a State, or the members of the Legislature thereof, is denied to any of the male inhabitants of such State, being twenty-one years of age, and citizens of the United States, or in any way abridged, except for participation in rebellion, or other crime, the basis of representation therein shall be reduced in the proportion which the number of such male citizens shall bear to the whole number of male citizens twenty-one years of age in such State.
3. No person shall be a Senator or Representative in Congress, or elector of President and Vice-President, or hold any office, civil or military, under the United States, or under any State, who, having previously taken an oath, as a member of Congress, or as an officer of the United States, or as a member of any State legislature, or as an executive or judicial officer of any State, to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof. But Congress may by a vote of two-thirds of each House, remove such disability.
4. The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions and bounties for services in suppressing insurrection or rebellion, shall not be questioned. But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void.
5. The Congress shall have power to enforce, by appropriate legislation, the provisions of this article.

  1. She is nuts. The 14th was adopted so no STATE could deny former slaves the equal protection of any law or their constitutional rights.
    The HC law clearly violates the Commerce Clause because nothing in that clause (or any part of the constitution) grants power to the government to punish citizens who don't 'commit' to commerce.

  3. The funny part about all this is that now that health care reform is actually becoming effective, fewer people want it repealed, even among Republicans.

    This whole tactic of the theater of repealing health care reform is blowing up in the Republican party's face.

    62% of real Americans want the bill in place as is or made stronger. Only 18% of real Americans want it repealed, and that's about the size of the tea party loyalists.

    The only reason they are taking this vote is to mollify their tea party base.

    They know it's not going anywhere and they know this vote is going to hurt them politically with independents.

  4. The Bill will NOT be repealed BUT the newly elected members will do what the LEFT did not,use common sense which again Bruce is NOT your forte! Conservative I know were always in favor of FIXING the system NOT making a NEW entitlement that cannot be PAID for.

    For starters why must Tax Payers pay for this Bill for 10 years but only get six years of Coverage?

    There will indeed be changes before this horrible bill is PAID for including finding out HOW you can take 500 Billion out of Medicare to help PAY for the Socialized Insurance when MEDICARE is about 10 to 12 Trillion in DEBT. Bruce what kind of Fuzzy math is that?

    The demoncrats are now out in full force saying Economy and Jobs are the Important Issues. To bad they did not address Citizens concerns FIRST! On Novemeber the 2nd this Regime was rejected by Citizens. Bruce what other explanation could there be for the Shellacing in Novemeber and through out the Year?

    Bruce the Independants Voted for exactly what is Happening in the House and We now Have HOPE from all the Leftist Change and that Bruce is what the VOTERS wanted!

    The bill is more popular now than before the election. Why?

    Real Americans are benefiting from it every day, parents whose children have had cancer and need to be taken care of and they can now get coverage.

    Real Americans whose adult children can now stay on their parents policy are grateful to Democrats now for passing reform.

    Real American seniors who are getting help with their prescription drugs are now grateful to Democrats, who, with no Republican votes passed health care reform

    The "shellacking" was a result of tens of millions of dollars of negative ads run against Democrats by corporations whose only interest is greed, and not real Americans who were suffering every day from lack of health care.

    The numbers don't lie, Al. 62% of real Americans are now in favor of the bill or want it to do even more.

  10. Al, the funniest thing I saw on television yesterday was Eric Cantor admonishing Democrats for blocking the health care repeal in the Senate.

    After over 130 filibusters in just the last session of Congress and 264 since 2006, he actually accused the Democrats of being obstructionists. What a joke.

    Do you know what the approval rating of the lame duck of Congress was, Al? 77% 61% of Republicans even approved.

    What is the message from that? Real Americans like it when Congress actually does shit.

    The country is already turning on the Tea party. Their approval is at an all time low and voters are already having buyers remorse over putting Republicans in charge of the House.

    Republicans don't have a plan to replace what they've voted to repeal.
